REGARDING CONDUCT OF .ELECTIONS

Subject: Police Personnel connected with election related duties -
exercise of supervisory/disciplinary control - Ensuing Bye-elections and Countermanded
elections in 13 States and 1 Union Territory in April-June 1995.
Sir/Madam,
The Commission vide its order No. 434/1/ESO26/94/MCS dated 24th October, 1994 had directed
that regardless of the nature of election (whether a General Election or a Bye-election)
the State Government/Union Territory Administration shall invariably designate:-
(i) The Director General of Police/Additional Director General of Police/Inspector General
of Police;
(ii) In a general election, all the police officers below the level of Director General of
Police borne on the strength of the State Government; and
(iii) In the case of a bye election, the Additional Director General/DIG/Commissioner of
Police under whose jurisdiction the constituency falls and all police officers below them
in the Districts/Constituencies concerned as designated officers for the purpose of
Section 28A of the R.P.Act, 1951.
2. The Commission has also directed that where any State Government/Union Territory
Administration fails to designate any individual police officer or class of police
officers of any rank as directed above mentioned order under section 28A of the
Representation of the People Act, 1951, the Commission will insist and ensure that such
police officers will not be allowed to deal with any election related work in any manner
whatsoever.
3. Bye-elections/countermanded elections in your States/Union Territory, subject to
fulfillment of all statutory and constitutional requirements, have been announced by the
Commission vide its Press Note no. 100/95/PS.I dated 4th April, 1995.
4. The Commission has, therefore, directed that the State Government/Union Territory
Administration shall strictly comply with the standing order of the Commission dated
24.10.1994 and designate Additional DGP/IGP/Commissioner of Police under whose
jurisdiction the Constituency falls and all police officers below them in the
district/constituencies concerned as designated officers for the purpose of Section 28A of
the R.P. Act, 1951. The Commission has further directed that such designations of officers
should be done on the same day the Governor/Commission issues the notification under
section 15/149/150 of the R.P. Act, 1951 and the compliance report in this regard shall
reach the Commission not later than the 1700 hours on the date of such notification
calling the bye election/Countermanded election in the State.
5. The receipt of this letter shall be acknowledged forthwith.
